11.3 Independent Contractors. Nothing in this agreement is intended for or creates any kind of joint venture, worker-employer, trust, partnership or trust between you and us or our related businesses. In addition, under this Agreement, neither Party shall be considered to be a representative or representative of the other Party. Neither party has the right and will not attempt to create or assume any obligation or liability, expressly or implicitly, on behalf of or on behalf of the other party. Without limiting the general quality of the foregoing, neither party will sign any contract, agreement or other commitment, provide any warranty or warranty, or make any commitment or liability on behalf of or on behalf of the other party. 5.1 Our Fees. You agree to pay the fees („Fees“) set out in our schedule if you use our Service. We reserve the right to change our fees at any time, including, but not limited to, in the event that we find that you suffer excessive refunds. All credits and all fees, charges and payments collected or paid through the Service are denominated in U.S. currency. All fees are calculated at the time we process a transaction. 11.3 Disputes. Any dispute or claim regarding the Service, your visit to the Website, Seller Central or the MWS Site, or the products or services we sell or distribute through the Website, Seller Central or the MWS Website (including, but not limited to, the Service), will be settled by binding arbitration and not by a court.

Except for the fact that you can assert claims in small claims court if your claims are justified. This Agreement is governed by the Federal Arbitration Act and the Federal Arbitration Law. There is no judge or jury in an arbitration proceeding and judicial review of an arbitral award is limited. However, an arbitrator may, on an individual basis, bring the same claim for damages as a court (including claims for omission and finding or statutory damages) and must comply with the terms of that agreement as a court. To initiate arbitration proceedings, you must send a letter in which you request arbitration and describe your claim to our Agent Agent Service Service Company, 300 Deschutes Way SW, Suite 304, Tumwater, WA 98051. Arbitration is conducted by the American Arbitration Association (AAA) in accordance with its rules, including the AAA`s supplemental procedures for consumer disputes. The aaa rules are available at www.adr.org or by phone at 1-800-778-7879. Payment of all registration, administration, and arbitration fees is subject to the AAA Rules. We reimburse these costs for claims totalling less than $10,000, unless the arbitrator finds that the claims are frivolous.
